I. Who is data controller?

Data controller is Netbiscuits GmbH, Europaallee 10, 67657 Kaiserslautern, Germany. This means that Netbiscuits determines the data processing steps performed on the Website.

II. What personal data do we collect and how we use them?

Personal Data” means any information concerning your personal or material circumstances on which basis we may identify you. The categories of Personal Data we collect, process and use (together “process”) depend on your use of the Website:

1. General use of the Website

You can access and use the Website without any Personal Data being processed. Please note that this only applies if you reject the use of cookies and related tools. See sec. III. of the Privacy Policy for information on the use of cookies and analytic-tools.

2. Contact forms and download a report

We collect your Personal Data that you submit to us when you enter your information into our contact forms. The contact forms allow for general requests or to contact our partner managers or to download reports relating to our business. We process these Personal Data to deal with your contact request.

If you have activated cookies and submit to us information through the contact form, you agree that we associate the data obtained through the cookies with the contact information provided. We will use this information exclusively for the purposes of dealing with your contact request and the purposes described for how the respective cookies are utilized. If you do not want us to connect this information, please do not use the functions to contact us.

3. Newsletter and updates on Netbiscuits

If you sign up for our newsletter we will process your Personal Data that you submit to provide you with updates on Netbiscuits’ Services and activities through our newsletter.

When signing up to the newsletter you also agree that we may contact you sporadically regarding promotional offers. If you do not want that we contact you this way, please do not sign up for the newsletter.

4. Software Services Agreement

(i) We process your Personal Data that you provide to us when you have entered into a Software Services Agreement (“SSA”) with us. We process your Personal Data to provide you with our Software Services and our Software as ordered and agreed to in the relevant SSA. These Personal Data include your contact person’s details, information regarding administration of your SSA and billing details. If we process Personal Data of End Users (i.e. individuals accessing a Customer’s website), we usually act as data processor. We encourage you to read the privacy policy of your website operator to this end.

(ii) Netbiscuits Visitor ID is a cross device detection solution that enables our Customers to learn more about their End Users and in particular if End Users access the Customer’s website using more than one device (e.g. smartphone, laptop, PC, etc.). Netbiscuits Visitor ID determines on the basis of certain surfing information (e.g. information on the device used, browser settings, IP address (location)) the likelihood if two or more devices can be assigned to one End User (matching). How Netbiscuits Visitor ID is exactly implemented into the Customer’s website is in the Customer’s discretion as Customers are able to adjust settings and turn on/off certain functions. We process your Personal Data on behalf of the respective Customers as data processor and do not use it for other purposes than described herein. If you want to learn more about how the operator of the website that you are accessing uses Netbiscuits Visitor ID, please see the operator’s specific privacy policy.

(iii) To a very minimal extent, we use the result of the matching with Netbiscuits Visitor ID – and only with your prior consent solicited for us by the operator of the website that you are accessing – to improve the accuracy of Netbiscuits Visitor ID. If you do not consent or withdraw your consent, we will not process or use your Personal Data in connection with the result of the matching. You can withdraw your consent here http://www.netbiscuits.com/visitor-id-opt-out/ by proceeding as described on the opt-out subsite. Please note that if you use more than one device or browser to access a Customer’s website, you will need to withdraw your consent from each device or browser as we memorize your withdrawal by placing an opt-out cookie on your device. Your withdrawal is permanent unless you choose to opt-in on the Website or on our Customers’ website or if you delete the opt-out cookie from your device. .

5. Use of “My Netbiscuits” (Customers only)

We process your Personal Data when you access our internet portal “MyNetbiscuits” to enable you to use and to operate “MyNetbiscuits”. This includes processing of the Personal Data you submit to us when signing up for our service, as well as creating your account(s). We process your email address, your name, and your company details at the time of your subscription. We process your phone number, job title, industry, country, and billing details (e. g. billing address, credit card details) additionally when you upgrade your subscription. We also process your information that you enter when using the portal as well as data that accrue technically when you use MyNetbiscuits (usage data).

What cookies and similar technologies do we use?

This section explains what cookies are and how we use them as part of the Website and its Services.

1. What are cookies?

3. How long will cookies stay on my browsing device?

5. Similar technologies used by Netbiscuits

Netbiscuits also uses electronic images known as web beacons (sometimes also called clear gifs or pixel tags). A web beacon is usually a small image that makes up the webpage or email that you are viewing. The viewing request of your device is recorded once your device fetches the image from the server. This provides us with basic information such as your IP-address, the time of your request and the type of your browser. We are using the information collected it to help us deliver cookies, count visits and to prevent fraud.

IV. Who receives your Personal Data?

In general, we do not disclose or transfer your Personal Data to any third party.

1. Disclosure to affiliates

We disclose and transfer your Personal Data to our affiliate Netbiscuits, Inc. for mutual business planning, business operations and marketing measures.

2. Use of data processor

We have engaged service providers that support our Services, such as provides of hosting services or customer-management tools. When you have entered into a SSA with us and pay by other means than wire-transfer, we engage service providers for billing and payment purposes. Our service providers are data processors that receive your Personal Data from us and that process your Personal Data only on our behalf. Our service providers have implemented adequate technical and organisational measures to ensure the protection of your Personal Data. We have established the necessary adequate level of data protection with service providers that are located outside the EU/EEA (e.g. through Safe-Harbor-Certification or EU-Standard Contractual Clauses).

V. Do our servers also collect anonymous access data?

During your visit of the Website our web servers collects anonymous access data for statistical purposes. These anonymous access data give us information about the access frequency of certain subpages of the Website and enable us to steadily improve the Website and our services we provide for you. We cannot identify you as individual with this anonymous access data.

VI. When is your data deleted?

After you have unsubscribed from our newsletter or any other service subscribed or used on the Website, we will no longer process your Personal Data except for statutory archiving purposes.

VII. What are your rights?

Pardot is Netbiscuits’ marketing automation platform used to provide you with news, invitations to surveys, product material, promotional announcement, newsletters and other marketing programs to the extent that you consented in the receipt of such news. Pardot hosts subsites for Netbiscuits in support of campaign elements such as landing pages, display ads, or promotional offers. The subdomain (www2.netbiscuits.com) gives visitors a seamless transition when travelling between pages and forms that are hosted by Netbiscuits and those that are hosted by Pardot. The CNAME cookie supports the transition by completing certain data fields for travelling between pages. For example, users will not have to enter their contact data twice as it is filled in through the cookie after it had been entered for the first time.
